We represented Elisa, Estonia’s leading telecommunications services provider, in a public procurement dispute with Estonian Railways, a railway infrastructure manager, in relation to the terms of a public tender announced by the latter.
In accordance with the law
At the EUR 300,000 tender, Estonian Railways sought to contract a provider of landline telephone services, including the rental of terminal equipment (IP phones and IP/analogue adapters) and mobile voice and data services during 2023-2027.
Compromise reached
The case was resolved rather unconventionally as the parties reached an agreement, essentially a compromise. Under the agreement, all of the disputed terms were reworded.
“Settling a dispute by agreement is a rare occurrence in the realm of public procurement and happens only a few times a year. Nevertheless, the settlement proves that procurement disputes can lead to satisfactory results without a dispute,” explained Mario Sõrm, the Sorainen senior associate who represented the client in the Public Procurement Review Committee.
