We helped a large Belarussian producer of pulp and paper products to continue fulfilling a contract, despite COVID-19 pandemic force majeure circumstances announced by the counterparty.
The foreign supplier stopped fulfilling its contractual obligations, justifying this with the epidemiological situation and claiming force majeure. With our help, the client prepared an answer categorically opposing termination of obligations and presenting convincing arguments for the absence of force majeure at the supplier’s end. This led to negotiations, resulting in the supplier recognizing the possibility of partial fulfillment of obligations and resuming fulfilment of the contract.
Our team, consisting of partner Alexey Anischenko and associate Valeria Dubeshka, advised the client.
