The Court of Appeal of Lithuania issued a favorable decision for our client, a company in Lithuania owned by the U.S. W. P. Carey investment fund, in a legal dispute against Kesko Senukai Lithuania regarding failure to pay rent for a logistics center owned by our client and rented to Kesko Senukai Lithuania.
The court acknowledged that Kesko Senukai Lithuania used the leased property for its intended purpose without suffering negative financial consequences and ordered them to pay our client, W. P. Carey’s fund company, 1.1 million euros for the unpaid rent and late payment interest.
The Supreme Court of Lithuania, in non-appealable rulings unfavorable to Kesko Senukai Lithuania, has already resolved two disputes concerning unpaid rent during the first quarantine period. The W. P. Carey” fund companies were awarded almost 1.9 million euros.
