Spreading misleading information about competing drugs can be an infringement of competition law
On 22 July 2024, the European Commission (EC) announced that it will be imposing certain commitments on Vifor, a manufacturer of intravenous iron medicines. Vifor is a dominant player in this market and had spread misleading information about the safety of a competing drug, Monofer, to healthcare professionals. The EC had opened an investigation, suspecting a potential competition law infringement. However, after concluding its investigation, instead of imposing fines, the EC imposed a set of legally binding commitments. Marcus Niin was appointed as the insurance conciliator of the Estonian Insurance Association
The Estonian Insurance Association appointed our senior associate Marcus Niin as the conciliator of the insurance conciliation body. His term begins on October 1, 2024, and lasts five years. “An insurance conciliator is an independent and impartial expert in insurance disputes. The conciliator aims to help resolve disputes between the insurer and the insured. The conciliation body resolves a significant portion of insurance disputes in Estonia,” Niin explains the work of the conciliation body. Reaching out to the conciliator is free of charge and it offers a much quicker resolution than court proceedings.
