Regulation (EU) 2025/327 on the European Health Data Space published in OJ

Official publication has been made of Regulation (EU) 2025/327 of the European Parliament and of the Council of 11 February 2025 on the European Health Data Space. The regulation aims to establish the European Health Data Space, which will enhance access to and control over personal health data for individuals. It will promote the use of this data, amongst other sectors, in healthcare, research and policymaking.

The Commission launches the process to allow free and safe data flows with the European Patent Organisation

Launched: 4 March 2025

The European Commission has started the process to allow data to flow freely and safely between the EU and EPO. To achieve this, the Commission proposed the first-ever EU adequacy decision for an international organisation: the European Patent Organisation (EPO). The Commission finds that the EPO provides comparable data safeguards to those of the EU. Once adopted, the decision will enable EU innovative entities to transfer data to the EPO without additional safeguards.

A preliminary reference from a Belgium court has been published in the Official Journal. The applicants in the main proceedings, amongst others, include Google LLC, Google Ireland Ltd, Spotify Belgium SA, Spotify AS, Meta Platforms Ireland Limited, Sony Music Entertainment Belgium SA, Universal Music SA. The questions referred concern the compatibility of national laws with EU law providing compulsory remuneration rights for authors and performers of sound or audiovisual works.

The Commission proposes Critical Medicines Act to strengthen the supply of critical medicines in the EU

Proposed: 11 March 2025

The Commission has proposed a Regulation which will improve the availability of critical medicines in the EU. The proposal aims to protect human health by incentivising supply chain diversification and boosting pharmaceutical manufacturing in the EU. The Act will facilitate investments for companies that increase EU manufacturing of critical medicines, while incentivising actions that make supply chains more resilient.

Competition

Official publication has been made of an action brought by Meta Platforms and Meta Platforms Ireland against the European Commission. The action contests the Commission’s EUR 797.72 million fine for breaching EU antitrust rules by tying its online classified ads service Facebook Marketplace to its personal social network Facebook and by imposing unfair trading conditions on other online classified ads service providers. The applicants are seeking the annulment of the Commission’s decision.
