Class actions are unlikely to become common in Estonia
Our team of lawyers, together with other prominent competition law practitioners, analyzed recent merger investigations and complaints and concluded that it is very unlikely that class actions will become common in Estonia. Even though mergers and acquisitions activity has been relatively high in Estonia during recent years, most of them have fallen below the notification thresholds.
The implementation of ECN+ Directive uncertain
The ECN+ Directive is created with the purpose of harmonizing competition law enforcement within the EU countries. The Directive was supposed to be implemented in all member countries by February 2021. In Estonia, the main contributor to the ECN+ Directive implementation is Estonian Competition Authority (ECA). It was found that due to the difficulties with adjusting current legislation to match the ECN+ Directive, the implementation process and timing still remain uncertain.
