Sorainen successfully represented Tauragë District Municipality in a court dispute over refusal to employ a person who won a competition for a secondary school manager’s position.
The claim was based on discrimination against the person and violation of equal rights. The claimant asserted that the municipality was obliged to conclude an employment contract since she was declared the winner of the competition regardless of the fact that it appeared that she did not comply with all the legal requirements. The court ruled that winning a competition does not automatically result in employment as some important circumstances may arise after the competition is closed. The case is significant since there has been no such type of case law in Lithuania so far.
The Sorainen team was led by partner Þygimantas Pacevièius and consisted of senior associate Jurgita Karvelë and associate Juliana Pavilovska.
